Hi

I need some advice for a friend. Her long time boyfriend has moved out - about a year ago and she is now stuck paying the mortgage and quite large loan as he is refusing to pay! She works for a bank so can't stop paying or will lose her job! She has seen a solicitor and cab but they say she can't do anything to make him pay!

I find this absolutely disgusting as she can't sell the house as it is only just with the mortgage and he is still on the mortgage.

There must be something that can be done?? Can anyone give me advice? She has paid out a lot of money this year and is finding it very tough!

Hi Cazza

She is jointly and severally liable for the mortgage, ie if they can't get it from one they can get it from the other. She has no choice than to keep paying. She can however see a solicitor to see what can be done about getting him off the mortgage although I think the only way this could happen would be to go to court to force the sale, and that would not be forcing a sale to her but to a third party. Basically if he doesn't want out there's nothing she can do about it and if the property continues to increase in value then he's entitled to the profit unless they had an agreement in place at purchase that states differently.

If the loan is in joint names then again she is jointly and severally liable and she'll need to keep paying.
