Hi everyone, I hope you don't mind me posting on your board. I have some questions as regards my children. I am separated since last Christmas, my children lived with me till may, but little by little my husband emotionally blackmailed them into feeling sorry for him and they decided that they would like to stay with daddy. My ex also made me feel inadequate. So I decided that it would be best to let them stay with their dad. But they are unhappy there now, he has a farm they spend long periods unattended, he doesn't take them to the doctors when they need to go etc etc. The children have told me that they want to live with me, one wants to stay with his dad. So I have talked about it with my ex and he obviously wasn't impressed. So now my children are saying they want to stay with their dad, and I know he has made them feel bad so that they say they want to stay. I refuse to do this. What can I do. I know my kids would be best with me. I am very close to my children. We have yet been to court so do I have the right to just keep my children and let my ex see them weekends etc or does it have to wait till we go to court. I was really really hoping to keep the kids out of court. Thanks for reading and sorry for the ramblings. Al x

The courts tend to stick with the status quo (that is living with your ex) unless there are avery good reasons for changing this. You will however be granted considerable time to see the as the non resident parent. If you can work things out with your ex without involving the courts, that would be best.

I would seek legal advice lovey and ask about possible mediation with your ex to see about the children being returned or at least a way around this...Try and see the children as much as possible and keep all lines of communication open.
